("Toothie", "we", "us", "our") has created this privacy policy ("Privacy Policy") in order to set out how we collect, use, and disclose information through our website located at www.toothie.ca (the "Website") as well as to information we collect and use when we provide services on behalf of our dental practice customers ("Practices"). This Privacy Policy applies to all of the products and services offered by Toothie, as well as the Website and other websites offered by Toothie or our related, affiliated and/or subsidiary companies (collectively the "Services"), unless another applicable privacy policy is posted on that Service.

    The privacy of our customers is of great importance to us. By visiting our Website and/or using the Services in any manner, you acknowledge that you have read the practices and policies outlined in this Privacy Policy and you understand that your information will be collected, used and disclosed in accordance with this Privacy Policy. If you do not agree with our policies and practices, you should not use the Website or the Services.

    1. Introduction

    Toothie provides a platform that connects patients with dental practices and offers practice management tools. In providing these Services, we may collect and process information about patients, dental professionals, and website visitors.

    2. What Does This Privacy Policy Cover?

    This Privacy Policy describes our collection, use and disclosure of information, including information which can be used to identify an individual ("Personal Information"). Personal Information does not include any anonymized information which we may create or derive from information (including Personal Information) you provide to us.

    Regulatory Compliance

    PHIPA (Canada)

    In Canada, Toothie is a service provider and may act as a service provider, information manager or electronic service provider under applicable privacy legislation, including Ontario's Personal Health Information Protection Act (PHIPA) regulations.

    PIPEDA (Canada)

    Toothie's collection, use, and disclosure of Personal Information is also governed by the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial equivalents.

    Toothie collects your information in several ways:

    • From Practices: Information we receive from dental practices when you interact with them through our Services.

    • Appointment Management: Facilitating the booking, rescheduling, and confirmation of dental appointments.
    • Communication: Sending notifications about appointments, Service updates, and promotional offers.
    • Revenue Cycle Management (RCM): Helping Practices manage insurance claims, fee schedules, and patient billing.
    • Improvement of Services: Analyzing usage patterns to enhance our Website and service offerings.
    • Promotional Offers: Managing eligibility and duration of free or discounted subscription periods for Practices.

    4. Matching Algorithm and Data Usage

    Toothie uses a proprietary matching algorithm to connect patients with dental practices. This algorithm considers various factors, including your geographic location, the type of dental service or procedure you are seeking, your insurance coverage, Practice availability, and patient reviews.

    5. Sharing and Disclosure of Information

    We may share your Personal Information with:

    • Dental Practices: Sharing your contact and health information when you express interest in or book an appointment.
    • Service Providers: Trusted third-party companies performing functions on our behalf (payment processing, data analysis, etc.).
    • Insurance Providers: Facilitating coverage verification and claim processing.
    • Business Transfers: Information may be transferred as part of a merger or sale of assets.
    • Legal Requirements: Disclosure if required by law or valid legal requests.

    6. Minors

    Toothie does not knowingly solicit or collect data from children under the age of 13. If you are under the age of 13, you are explicitly not authorized to use these Services.

    7. Website Information, Cookies, and Analytics

    We gather information about our Service's traffic and store it in log files. We use cookies for authentication and session management. We use Google Tag Manager and the Meta (Facebook) Pixel to understand user interactions and to measure and deliver advertising on Meta's platforms; some interactions on our Website may accordingly be shared with Google and Meta. After a completed appointment, we may share your name and email address with Trustpilot so they can invite you, on our behalf, to leave a review.

    8. Storage Location and Transfer

    Toothie processes and stores data on secure cloud servers located in the United States and Canada. By using our Services, you consent to the transfer of your information to these locations.

    9. Data Security

    We implement technical, physical, and administrative measures designed to secure your Personal Information, including encryption of sensitive data (like PHI) and regular security assessments.

    10. Retention

    We retain your Personal Information only for as long as necessary to fulfill the purposes for which it was collected, including satisfying legal or reporting requirements.

    13. Nevada Privacy Rights

    Nevada residents have the right to request that we do not sell your "covered information". Toothie does not sell your information.
