1. Agreement to Terms

Welcome to Toothie! These Terms and Conditions outline the rules for using our website and services. By accessing or using our platform, you agree to follow and be legally bound by these terms. If you do not agree with any part of these terms, please refrain from using our services.

2. Description of Services

Toothie provides a digital platform that assists users in finding and connecting with dental care providers based on their specific needs. Please note that we are not dental service providers ourselves; we simply facilitate the connection between you and the clinics.

Rewards Program Eligibility

Eligible patients can earn $100 after completing their first visit, and another $100 after completing a second visit at the same clinic within one year of the first visit - up to $200 total.

To participate in our rewards program and qualify for gift cards:

Finish a new patient examination plus a secondary service, such as a cleaning. Please note that exams or X-rays on their own are not eligible for the reward.

The patient must be 10 years of age or older.

This must be your first time receiving a reward from Toothie in the past 1 year.

The offer is only valid for patients who have never visited that specific clinic before.

Private insurance is required; government-funded plans do not qualify, with the exception of the CDCP.

Booking details must match your Toothie profile. For families or groups, each individual must use their own account to receive a reward.

3. Communication and Call Recording

By using Toothie to connect with dental clinics, you acknowledge and agree that phone calls facilitated through our platform may be recorded and monitored for quality assurance, training, and dispute resolution purposes.

An automated message will notify you at the beginning of the call if recording is taking place. By continuing the call after this notification, you consent to the recording of the conversation in accordance with applicable privacy laws.

4. User Accounts

Registration: You may need to create an account to access specific features. You agree to provide accurate, up-to-date, and complete information.

Responsibility: You are entirely responsible for keeping your account credentials confidential and for all activities that happen under your account.

Termination: We reserve the right to suspend or close your account if you violate these Terms and Conditions.

5. User Conduct

You agree not to use our platform for:

Any activity that is unlawful, harmful, or disrupts others' use of the platform.
Posting or sharing content that violates anyone's intellectual property or personal rights.
Distributing viruses, malware, or any other harmful digital code.

6. Intellectual Property Rights

All content on the Toothie platform—including text, graphics, logos, images, and software—is the exclusive property of Toothie or its licensors and is protected by copyright and intellectual property laws.

Unauthorized use, reproduction, modification, or distribution of our content is strictly forbidden and may lead to legal consequences. We will take legal action against anyone who infringes on our intellectual property rights to the fullest extent of the law. All rights not explicitly granted here are reserved by Toothie.

7. Disclaimers

No Warranties: Our services are provided "as is" and "as available" without any guarantees. Toothie does not promise that the services will always meet your needs or be uninterrupted.

No Endorsement: We do not officially endorse or validate the dental professionals listed on our platform. Choosing to rely on any service provided by a dental professional is done at your own risk.

8. Limitation of Liability

Toothie, along with its directors, employees, and affiliates, will not be held liable for any direct, indirect, incidental, or consequential damages. This includes financial losses, data loss, or any other claims arising from your use of the service or products found through our platform, even if we were advised of the possibility of such damages.

9. Indemnification

You agree to defend and hold Toothie and its affiliates harmless from any claims, losses, or expenses (including legal fees) resulting from your use of the service, your breach of these terms, or any content you post.

10. Changes to Terms

We may modify or replace these terms at our discretion. By continuing to use the service after changes take effect, you agree to be bound by the updated terms.

11. Governing Law

These terms are governed by the laws of Alberta, Canada. Any disputes will be handled in accordance with the legal provisions of that jurisdiction.
